FDA to Investigate Risks Related to Testosterone Therapy
On January 31, the U.S. Food and Drug Administration (FDA) announced that it is investigating the risk of stroke, heart attack, and death in men taking FDA-approved testosterone products. This decision follows the recent publication of two separate studies that each suggested an increased risk of cardiovascular events among groups of men prescribed testosterone therapy.

CMS Delays 2-Midnight Rule a Third Time
On January 31, 2014, the Centers for Medicare & Medicaid Services (CMS) announced that it will delay enforcement of the 2-Midnight Rule; the new effective date is October 1, 2014. Under the Inpatient Prospective Payment System final rule for fiscal year (FY) 2014, a hospital admission is assumed to be appropriate for Medicare Part A payment if the physician expects a patient's treatment to require a two-night hospital stay and admits the patient to the hospital under that assumption. A hospital stay less than two nights is presumed to qualify for payment under Medicare Part B.
In September 2013, CMS released guidance instructing Recovery Audit Contractors (RACs) to delay review of short inpatient stay claims until December 31, 2013, as previously reported in Health Policy Brief, to give providers more time to adjust to the new rule. Enforcement of the rule was postponed a second time to March 31, 2014, following complaints from providers. The most recent delay extends the Inpatient Hospital Prepayment Review for probe and education period through September 30, 2014. According to CMS, this means that:
- Medicare Administrative Contractors (MACs) will continue to select claims for review with dates of admission between March 31, 2014 and September 30, 2014. The MACs will continue to review and deny claims found not in compliance with the 2-Midnight Rule.
- MACs will continue to hold educational sessions with hospitals through September 30, 2014.
- Generally, Recovery Auditors and other Medicare review contractors will not conduct post-payment patient status reviews of inpatient hospital claims with dates of admission on or after October 1, 2013 through October 1, 2014.

New EHR Attestation Deadline for Eligible Professionals: March 31, 2014
CMS is extending the deadline for eligible professionals to attest to meaningful use for the Medicare EHR Incentive Program 2013 reporting year from 11:59 pm ET on February 28, 2014 to 11:59 pm ET March 31, 2014.
This extension will allow more time for providers to submit their meaningful use data and receive an incentive payment for the 2013 program year, as well as avoid the 2015 payment adjustment.
