Making Sense of Stark II: Federal self-referral restrictions modified once again
On July 26, 2004, urologists became subject to new rules related to the federal (Stark II) self-referral prohibition. These rules were part of the second phase of the Stark II rulemaking published by the Centers for Medicare and Medicaid Services (CMS) on March 26, 2004 (Physicians' Referrals to Health Care Entities With Which They Have Financial Relationships). This educational article will review basic principles regarding the Stark law, and will highlight recent changes to the related regulatory policies.
Urologists must continue to pay close attention to regulatory requirements, including the new Stark II regulations.
